These terms govern your use of CaskID's whisky cask verification platform. Please read them carefully.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Caskmark Ltd, a company registered in Scotland under company number SC850557, trading as CaskID ("CaskID", "we", "us", or "our").

By accessing or using the CaskID platform at cask.id (the "Service"), you agree to be bound by these Terms. If you disagree with any part of these terms, you do not have permission to access the Service.

2. Service Description

2.1 Core Services

CaskID provides a whisky cask verification and authentication platform that facilitates multi-party verification between owners, brokers, warehouses, and distilleries.

Our services include:

  • AI-powered visual fingerprinting and fraud detection
  • Multi-party verification coordination
  • Digital cask record management
  • Blockchain-anchored certification
  • Basic analytics tools (user-defined, not investment advice)

2.2 Verification Levels

CaskID facilitates four types of verification, each represented by a distinct badge:

🏠 Owner Verified

The listed owner has claimed ownership and provided documentation/photos of the cask

🏢 Broker Verified

A licensed broker has confirmed they facilitated the sale/transfer of this cask and verified its authenticity

🏭 Warehouse Verified

The storage warehouse has confirmed physical custody of the cask and verified its location/condition

🥃 Distillery Verified

The originating distillery has authenticated this cask as genuine production from their facility

Each badge represents independent verification from that party. Multiple badges strengthen authentication but do not guarantee absolute legitimacy.

3. Important Disclaimers

3.1 No Investment Advice

CaskID does not provide investment, financial, legal, or tax advice.

We authenticate cask documentation and facilitate verification processes but do not guarantee cask values, investment returns, or market performance. Any analytics tools provided are for informational purposes only.

3.2 Verification Limitations

CaskID verifies the authenticity of photos and documentation provided to us.

We do not:

  • Physically inspect casks
  • Guarantee the current physical condition of any cask
  • Ensure the accuracy of information provided by third parties
  • Guarantee protection against all forms of fraud

We can only work with the information and materials provided to us. The quality of verification depends on the quality of submitted materials.

3.3 AI Technology Disclaimer

Our AI verification models are continuously improving but are not infallible.

We make no guarantees regarding AI accuracy as fraud techniques evolve constantly. Better quality images result in more reliable fingerprinting.

4. User Accounts

4.1 Account Registration

You must provide accurate, complete, and current information during registration.

One person or entity may only maintain one account. Accounts are personal and non-transferable.

4.2 Account Types

  • Standard Accounts: For individual cask owners and investors
  • Professional Accounts: For brokers, warehouses, and distilleries (requires verification and approval)

Professional entities requiring multiple functions (e.g., broker with warehouse) must maintain separate accounts for each role.

4.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Fees and Payment

5.1 Subscription Structure

Year One: Choose from three annual plans:

Collector

£59-79/year

includes verification coordination for 1 cask

Collector+

£99-139/year

includes verification coordination for up to 2 casks

Pro Portfolio

£179-219/year

includes verification coordination for up to 4 casks

"Verification coordination" means we:

  • Process and validate your cask submission
  • Apply AI fraud detection to submitted images
  • Create digital cask records
  • Send verification requests to relevant parties
  • Coordinate responses from brokers, warehouses, and distilleries

We do not guarantee that any party will verify your cask or issue badges. Verification depends on third-party cooperation and the accuracy of your submitted information.

Year Two onwards: Maintenance fees per cask:

  • 1-5 casks: £2.99/cask/month
  • 6-10 casks: £1.99/cask/month
  • 11+ casks: £0.99/cask/month

5.2 Transfer Fees

Cask ownership transfers incur a £39 fee for re-verification and updating records.

This fee is refundable if the transfer is rejected. If you sell a cask outside CaskID (without transfer), you should mark it as sold in your account to stop maintenance fees.

5.3 Refund Policy (365-Day Verification)

"Third-party verification" means at least one of: Broker Verified, Warehouse Verified, or Distillery Verified badges.

If your cask has not received third-party verification within 365 days, you may request a 50% refund of your Year One subscription fee. The 365-day period starts on the date we confirm your submission is complete and eligible for verification.

5.4 Extra Cask Verifications

If you need to verify more casks than included in your plan, additional verifications can be purchased at £69 per cask.

5.5 Founding Member Pricing

The first 200 subscribers receive founding member pricing. This special rate is locked for the first year.

5.6 Renewals & Cancellation

Subscriptions renew automatically for successive periods matching the initial term unless cancelled. You can cancel at any time via My Account or by emailing support@cask.id. Cancellation takes effect at the end of the current paid term; you retain access until then. We send renewal reminders at least 3 days before monthly renewals and 14 days before annual renewals.

5.7 Right to Cancel (Consumers)

If you are a consumer, you may cancel within 14 days of purchase for a refund. If you ask us to begin verification during this period, you agree we may deduct a reasonable amount to reflect services provided up to cancellation. This does not affect your statutory rights.

5.8 Inactive Accounts

If you stop paying maintenance fees without formally cancelling:

  • Your cask's "owner verified" status becomes inactive
  • We cannot alert you if someone uploads similar cask details
  • Other verification badges remain but are marked as "ownership unconfirmed"
  • You can reactivate by resuming payments

5.9 Price Changes

We will provide 30 days' notice of any price changes via email. Continued use after price changes take effect constitutes acceptance.

5.10 Payment Processing

Payments are processed through Stripe. By providing payment information, you agree to Stripe's terms and conditions.

All prices include VAT where applicable.

6. Intellectual Property

6.1 CaskID Property

CaskID retains all rights to:

  • The CaskID platform and technology
  • CaskID identifiers and certificates
  • AI models and fingerprinting technology
  • Aggregated and anonymized data

6.2 User Content License

By uploading content to CaskID, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Use cask images to improve our AI fraud detection models (anonymised/pseudonymised where feasible)
  • Process and display your content for verification purposes
  • Create anonymized market reports and analytics

You retain ownership of your documents and receipts and may request their removal at any time.

You may opt out of allowing your images to be used to improve our AI models at any time by emailing privacy@cask.id. Opting out will not affect our processing of your content to provide the Service.

6.3 Professional Use of CaskID Badges

Professional accounts may reference CaskID badges provided that (i) usage is truthful and not misleading; (ii) badges are unaltered; (iii) you comply with any brand guidelines we provide; and (iv) we may revoke permission on reasonable notice.

8. Data Protection and Privacy

We are registered with the Information Commissioner's Office (ICO) and comply with UK data protection laws.

Our detailed Privacy Policy at cask.id/privacy explains how we collect, use, and protect your data.

You have the right to:

  • Access your personal data
  • Request correction of inaccurate data
  • Delete your account and associated data (subject to audit requirements)
  • Export your cask data

ICO Registration No: [ADD YOUR NUMBER]. We retain verification documents for the duration of your account and for up to 6 years thereafter to comply with legal and audit obligations, after which they are securely deleted or anonymised.

10. Limitation of Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable law. These Terms do not affect any non-excludable statutory rights.

10.1 Service Liability

CaskID's total liability for any claim related to the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10.2 Exclusions

To the extent permitted by law, we are not liable for:

  • Investment losses or missed opportunities
  • Third-party verification errors or fraud
  • Actions taken based on verification results
  • Indirect, incidental, or consequential damages
  • Loss of profits or business opportunities

10.3 Third-Party Verifications

CaskID facilitates but does not control verifications by brokers, warehouses, or distilleries.

Each party is responsible for their own verification accuracy.

11. Warranties and Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, except as required by law.

To the maximum extent permitted by law, we disclaim all implied warranties including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of information

Consumer rights: If you are a consumer, you have legal rights in relation to services not carried out with reasonable skill and care. Nothing in these Terms affects those legal rights.

13. Dispute Resolution

13.1 Informal Resolution

Before pursuing formal proceedings, parties must attempt good faith negotiation for 30 days.

13.2 Formal Proceedings

  1. Written notice must be sent to legal@cask.id 30 days before any legal action
  2. Notice must describe the dispute and desired resolution
  3. Optional mediation through UK Mediation Service
  4. If unresolved, either party may pursue court proceedings

13.3 Jurisdiction

These Terms are governed by the laws of Scotland.

Any disputes shall be resolved in the Scottish courts. Where eligible, claims may be brought under Scotland's Simple Procedure.

13.4 Time Limits

To the extent permitted by law, claims must be brought within 12 months of when you knew or should reasonably have known about the issue. This limitation does not apply where prohibited by law (including in certain consumer contexts).

15. Geographic Restrictions

The Service is currently available only to users in the United Kingdom.

We make no representations that the Service is appropriate or available in other locations.

Note: Whisky cask investments are not regulated by the Financial Conduct Authority (FCA). CaskID provides verification services only, not investment services.
